1. Agreement to Terms

These Terms of Use ("Terms") are a legally binding agreement between you ("you" or "User") and Mykyta Popov ("VinoPrep," "we," or "us"), governing your use of the VinoPrep mobile application and related services (the "Service").

By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, uninstall the app and do not use the Service.

These Terms incorporate our Privacy Policy by reference.

2. Age Requirement and Eligibility

2.1 Minimum Age

VinoPrep contains educational content relating to wine and spirits. The Service is available only to users who meet the following minimum age requirements:

By using the Service, you represent that you meet the applicable age requirement for your jurisdiction.

2.2 Educational Purpose Only

VinoPrep is an exam preparation tool. Content relating to wine and spirits is presented strictly in an academic context aligned with the WSET curriculum. Nothing in the Service encourages, promotes, or implies the consumption of alcohol.

3. WSET Trademark and Independence Disclaimer

3.1 Independent Third-Party Application

VinoPrep is an independent, unofficial exam preparation application. It is NOT affiliated with, endorsed by, sponsored by, or officially connected to the Wine & Spirit Education Trust (WSET) in any way.

WSET® is a registered trademark of the Wine & Spirit Education Trust. All references to WSET, WSET Level 1, WSET Level 2, WSET Level 3, WSET Diploma, and Systematic Approach to Tasting® (SAT) within the Service are made solely for nominative, descriptive, and educational reference purposes to identify the certification exams for which users are preparing.

3.2 No Guarantee of Exam Outcome

VinoPrep provides study assistance based on publicly available WSET curriculum frameworks. However:

• We do not guarantee a passing score or any specific outcome on WSET examinations
• WSET may update its curriculum or exam format at any time; our content may not immediately reflect such changes
• VinoPrep content is not a substitute for official WSET study materials, which must be obtained through WSET Approved Programme Providers (APPs)

3.3 No Alcohol Recommendation

Nothing in the Service constitutes advice to purchase, consume, or handle alcoholic beverages. All content is provided in a purely academic and educational context.

4. No Account Required

VinoPrep operates without user accounts. You do not register, log in, or provide any personal information to access the Service. All study progress is stored locally on your device. If you delete the app, your progress will be permanently lost and cannot be recovered.

5. Subscriptions, Payments, and Refunds

5.1 Free Tier

VinoPrep offers a free tier with access to limited content (WSET Level 1 flashcards) and restricted quiz functionality (5 quizzes per day). Mock exams, full Level 2 and Level 3 content, and advanced analytics are not available in the free tier.

5.2 Premium Subscription

Premium subscriptions unlock full access to all content and features. Pricing:

Prices shown in the App Store or Google Play at the time of purchase are definitive and may be subject to applicable taxes.

5.3 Subscription Management

Subscriptions are managed entirely through your Apple ID (iOS) or Google account (Android) — VinoPrep does not manage billing directly. This means:

• Auto-renewal and cancellation are handled in your device's subscription settings
• We do not have access to your payment details
• Billing disputes must be addressed to Apple or Google directly

To cancel: Open your device's subscription settings, find VinoPrep, and cancel before the next renewal date. Cancellation takes effect at the end of the current billing period.

5.4 Lifetime Access

"Lifetime" access means access for the supported lifetime of the VinoPrep application. If VinoPrep is discontinued, lifetime access ends at that point. We will provide at least 90 days' notice before any discontinuation.

5.5 Refund Policy

All purchases are processed through the Apple App Store or Google Play Store. We do not process refunds directly. Refund requests are subject to the platform's own policies:

5.6 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice via in-app notification before any price change takes effect for new subscribers. Existing active subscribers will be notified in advance of their next renewal.

6. Intellectual Property

6.1 Our Content

All content created by VinoPrep — including flashcard text, quiz questions, explanatory notes, UI design, illustrations, and the spaced repetition algorithm configuration — is owned by or licensed to Mykyta Popov and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial, educational purposes only.

6.2 Restrictions

You may not:

• Copy, reproduce, distribute, or create derivative works from any Service content
• Reverse engineer, decompile, or disassemble any part of the Service
• Scrape or extract content using automated means
• Use the Service or its content to build competing products or services
• Remove any copyright, trademark, or proprietary notices

6.3 Third-Party References

• WSET® and Systematic Approach to Tasting® (SAT) are trademarks of the Wine & Spirit Education Trust, used descriptively
• Geographic indication names (e.g., Champagne, Bordeaux, Burgundy) and appellation designations are used for educational reference only
• Wine producer and brand names referenced in content are used for educational purposes and imply no commercial affiliation

7. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Interfere with or disrupt the technical operation of the Service
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Distribute malware or other harmful code through or in connection with the Service
• Post or transmit content that promotes excessive or irresponsible alcohol consumption
• Use the Service if you do not meet the minimum age requirement

8. Third-Party Services

The Service integrates the following third-party tools. Your use of the Service is also subject to their respective terms:

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
• CONTENT WILL BE COMPLETE, ACCURATE, OR UP TO DATE AT ALL TIMES
• USE OF THE SERVICE WILL RESULT IN ANY PARTICULAR WSET EXAMINATION OUTCOME

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VINOPREP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF STUDY PROGRESS, OR ANY EXAM-RELATED OUTCOMES.

IN ALL CASES, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IF YOU ARE ON A FREE PLAN, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Service Changes and Discontinuation

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will use reasonable efforts to provide advance notice of material changes via in-app notification. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Governing Law and Disputes

These Terms are governed by the laws of Poland. Any disputes that cannot be resolved informally through vinoprep.support@stockguard.app within 30 days may be submitted to the courts of Poland as the place of exclusive jurisdiction, unless otherwise required by applicable consumer protection law in your country.

Japan: Disputes may be referred to the relevant consumer consultation service (国民生活センター / 188).
South Korea: Disputes may be referred to the Korea Consumer Agency (한국소비자원 / 1372).

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notice and an updated "Last Updated" date. Continued use after the effective date of any change constitutes acceptance. If you do not agree to updated Terms, stop using the Service.

14. App Store Terms

Use of VinoPrep via the Apple App Store is also subject to Apple's Media Services Terms and Conditions. Apple is not a party to these Terms and bears no responsibility for the Service.

Use of VinoPrep via the Google Play Store is also subject to Google Play's Terms of Service.

15. Severability

If any provision of these Terms is held to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.

16. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and VinoPrep with respect to the Service.
